The Trademark Trial and Appeal Board decides who gets to keep a registration. We represent applicants and registrants on both sides.
An opposition stops an application before it registers; you have thirty days from publication, extendable. A cancellation attacks a registration that already exists. Both are litigation with a smaller courtroom: pleadings, discovery, briefs, and a decision from the Board.
Most matters settle. A coexistence agreement that draws a clear line between two businesses is often the right answer, and we’ll say so when it is, because it costs you a fraction of a fight. When it isn’t, we take the case through.
